McIlroy case to be settled out of court after all?

By: Golf Shake | Tue 03 Feb 2015

AND so it begins. In a courtroom in Dublin, Rory McIlroy and his former management company, Horizon Sports Management, will, over the course of the next few weeks, air their dirty linen in public. Or will they?

The case was due to begin this morning, but was promptly adjourned until 2pm and then again until 4pm. With the court packed, Judge Brian Cregan agreed to give lawyers for both sides time to open discussions, sparking fresh hopes that the dispute could be solved.

Paul Gallagher, representing McIlory, said that the case was due to last for up to eight weeks but added that lawyers for both sides were prepared to open talks about some of the areas at the centre of the dispute.

Horizon claim that McIlroy breached his contract with them, while he says that he was coerced into signing and did not receive proper legal advice. Horizon are suing the golfer, claiming that they are entitled to a percentage of his sponsorship earnings to the end of 2019. McIlroy is counter-suing, claiming that Horizon's fees (between 15% and 20% of his sponsorship income) were excessive.

The two parties tried and failed to come to an out-of-court agreement, leaving them with no option but to face one another in the High Court.

McIlroy has previously claimed that an agreement that he signed when he was 22 is invalid and unenforceable on a number of grounds. He said he was inexperienced and did not have independent legal advice at the time. At the centre of the dispute is McIlroy's contract with Nike, which is reputed to be worth $100m.
